Last Will and Testament
of Elena Margaret Whitfield
I, Elena Margaret Whitfield, a resident of the County of Kings, City of Brooklyn, State of New York, being of sound mind and memory and not acting under duress, menace, fraud, or undue influence of any person, do hereby make, publish, and declare this to be my Last Will and Testament, hereby revoking all wills and codicils previously made by me.
I am married to Samuel David Whitfield, hereafter referred to as “my spouse.” All references herein to my children refer to the following:
- Maya Elena Whitfield, born August 14, 2012
- Noah James Whitfield, born March 3, 2017
If any reference is made herein to “my descendants,” such reference shall include the children listed above and any lawful issue of theirs born or adopted after the execution of this will.
I nominate and appoint my spouse, Samuel David Whitfield, as the Executor of my estate. If my spouse is unable or unwilling to serve, I nominate my sister, Priya Iyer, of San Francisco, California, to serve as successor Executor.
I direct that no bond be required of any Executor named herein. My Executor shall have full power to settle, compromise, or contest any claim in favor of or against my estate without court approval.
I make the following specific bequests, to be distributed prior to the residuary estate:
- I give my grandmother’s pearl necklace (single strand, Mikimoto, ca. 1958) to my daughter, Maya Elena Whitfield, if she survives me. If she does not survive me, the necklace shall pass to her child if she has one, and otherwise to my son, Noah James Whitfield.
- I give the sum of Ten Thousand Dollars ($10,000.00) to The Trevor Project, a 501(c)(3) charitable organization (EIN 95-4681287). This gift shall be a fixed sum and shall not be reduced if the value of my estate decreases.
- I give my personal library of design and architecture books to my colleague, Marcus Chen, with the request (but not the requirement) that he share any duplicates with the Pratt Institute library.
I give, devise, and bequeath all the rest, residue, and remainder of my estate, of whatever kind and wherever situated, including any property over which I have a power of appointment (“my residuary estate”), as follows:
- If my spouse, Samuel David Whitfield, survives me, I give my entire residuary estate to him outright.
- If my spouse does not survive me, I give my residuary estate to my then-living descendants, per stirpes.
- If neither my spouse nor any of my descendants survives me, I give my residuary estate in equal shares to my parents, Margaret and Henry Iyer, or to the survivor of them, and if neither parent survives me, then to my sister, Priya Iyer.
If my spouse does not survive me, I nominate my sister, Priya Iyer, of San Francisco, California, as Guardian of the person and property of any of my children who are minors at the time of my death.
If Priya Iyer is unable or unwilling to serve, I nominate Rachel and Daniel Whitfield (my spouse’s brother and sister-in-law), of Portland, Oregon, as successor Guardians.
I expressly direct that, to the greatest extent practicable, my children should remain together in the same household.
My Executor shall have, in addition to those powers conferred by law, the following powers, exercisable in the Executor’s sole discretion without court order or accounting:
- To retain, sell at public or private sale, lease, mortgage, pledge, or exchange any real or personal property of my estate, on such terms as the Executor deems appropriate.
- To invest and reinvest the assets of my estate in such property and securities as the Executor deems prudent, without regard to any rule of law limiting fiduciary investments.
- To employ attorneys, accountants, investment advisors, and other professionals, and to pay reasonable compensation for their services from my estate.
- To distribute assets in kind, in cash, or partly in each, and to make non-pro-rata distributions among beneficiaries.
- To compromise, settle, or abandon any claim in favor of or against my estate.
I have separately prepared a Letter of Instruction and a Funeral & Burial Directive, which my Executor and family are encouraged to consult. Those documents are not part of this Will and may be updated by me at any time without amending this Will.
I direct that my remains be cremated, with a simple gathering for family and close friends at a location of my spouse’s choosing. No public obituary is required, though my colleague Marcus Chen may write one if he wishes.

The foregoing instrument was on the date thereof signed, published, and declared by the Testator as her Last Will and Testament, in our presence, who, at her request, in her presence, and in the presence of each other, have signed our names as witnesses.
